Buyers and sellers (clients) are not responsible to pay any fee to a real estate broker affiliated with 1031tax.com unless agreed to in writing. This agreement applies to properties specifically emailed to you by a real estate broker affiliated with 1031tax.com. Upon successful closing, real estate brokers affiliated with 1031tax.com may receive a fee from the Buyer, Seller, Broker, Lender or Qualified Intermediary. Client or real estate brokers affiliated with 1031tax.com may terminate this agreement for any (or no) reason upon five days prior notice to the other party, provided that any fees earned by real estate brokers affiliated with1031tax.com prior to the receipt of such notice shall be paid by client. Real estate brokers affiliated with 1031tax.com shall not be liable for not sending a property to client the actual first day property is available for sale. “First Day on the Market” referenced on website means a) Property is new to market (first day property is received by real estate brokers affiliated with1031tax.com). b) Price has been reduced or other substantive changes. c) The first time real estate brokers affiliated with 1031tax.com sends property to client (property may have previously been available for sale).
Real estate brokers affiliated with 1031tax.com receive and provide "for sale" property information from other real estate brokers, developers and sellers. Real estate brokers affiliated with1031tax.com have not verified the information provided and make no guarantee, warranty or representation about its accuracy or availability. Real estate brokers affiliated with 1031tax.com do not represent Buyer or Seller. Real estate brokers affiliated with 1031tax.com do not provide financial planning, accounting, due diligence, engineering, tax, legal or Qualified Intermediary services. Client and his or her tax, legal and financial advisors are advised to: (i) independently confirm the accuracy of all information (ii) investigate the property to determine suitability for investment and (iii) independently and diligently perform contractual obligations. It is client's responsibility to meet his or her contractual deadlines contained in any contract(s) to purchase property. Real estate brokers affiliated with 1031tax.com reserve the right in its sole discretion to not submit offers to purchase property where it deems appropriate. Clients and other real estate brokers agree to indemnify and hold real estate brokers affiliated with 1031tax.com harmless from any and all monetary or other damages caused from a delayed, failed or unsatisfactory transaction. Buyer confirms they will not contact seller or seller’s broker regarding any property received from real estate brokers affiliated with 1031tax.com without prior written approval from real estate brokers affiliated with 1031tax.com. Client must interview and approve any broker, lender, qualified intermediary, attorney, CPA or other professional referred by real estate brokers affiliated with 1031tax.com. This Agreement is made in the State of Colorado and shall be governed by Colorado law. This Agreement shall be binding upon, and inure to the benefit of, the parties and their respective heirs, representatives, executors, successors and assigns and all parties hereby consents to Venue and Jurisdiction of Colorado Courts to resolve any and all disputes arising under this agreement. This Agreement contains the entire agreement between the parties and supersedes all prior or other agreements, promises and representations. This Agreement shall not be modified or amended except in writing signed by both parties. 1031tax.com is a website, not a real estate brokerage, and is a registered trade name of Real Estate Foundation Inc. ("REF").
Any reference made herein to 1031tax.com and Jim Slinkard shall be completely separate and independent of REF and its brokers or employees. Jim Slinkard is an independent real estate broker with no fiduciary or brokerage relationship with REF. Jim Slinkard may pay a traditional referral fee to REF. Clients working with Jim Slinkard agree to all provisions above and shall specifically indemnify and hold REF and its brokers / employees harmless from all liability.
Any references made herein to 1031tax.com and REF include but are not limed to all employees of REF and Alan Fruitman in his capacity as President and Managing Broker of REF.
